Motivos y principales alegaciones Las demandantes, actualmente agentes contractuales afectadas a la actividad de los jardines de infancia y de las guarderías de Bruselas, desempeñaban estas mismas funciones ya antes de su nombramiento, en virtud de unos contratos de trabajo sujetos al Derecho belga. Impugnan su clasificación y su remuneración fijadas por la demandada cuando fueron nombradas agentes contractuales.
En el primer motivo de su recurso, las demandantes alegan que, con arreglo a las DGE y otras disposiciones relativas a los agentes contractuales de la Comisión, deberían haber sido clasificadas en el grupo de función III, en vez de en el grupo de función II, habida cuenta de su título y su antigüedad.
En el segundo motivo, las demandantes se quejan en particular de que no se benefician de la remuneración mínima prevista en el artículo 6 de las DGE.
En el tercer motivo, las demandantes invocan la infracción del artículo 2, apartado 2, del Régimen aplicable a los otros agentes (RAA) y del Memorándum de acuerdo celebrado el 22 de enero de 2002 entre la Comisión y la delegación del personal de los jardines de infancia y guarderías contratado conforme al Derecho belga, así como la vulneración del principio de no discriminación y de los principios generales en materia de la seguridad social. En particular, sostienen que en el cálculo de la remuneración que se debe garantizar a las demandantes no se tenía que haber tomado en cuenta los complementos familiares.
