1) El artículo 1, apartado 1, de la Directiva 2001/23/CE del Consejo, de 12 de marzo de 2001, sobre la aproximación de las legislaciones de los Estados miembros relativas al mantenimiento de los derechos de los trabajadores en caso de [transmisiones] de empresas, de centros de actividad o de partes de empresas o de centros de actividad, debe interpretarse en el sentido de que el concepto de «transmisión de un centro de actividad» abarca una situación en la que se disuelve una empresa activa en el mercado de los vuelos chárter por parte de su accionista mayoritario, que es a su vez una empresa de transporte aéreo, y en la que, posteriormente, esta última asume la posición de la sociedad disuelta en los contratos de arrendamiento de aviones y en los contratos vigentes de vuelos chárter, desarrolla la actividad antes efectuada por la sociedad disuelta, readmite a algunos de los trabajadores hasta entonces afectados a esa sociedad y los coloca en funciones idénticas a las ejercidas anteriormente y recibe pequeños equipamientos de esa sociedad.
2) El artículo 267 TFUE, párrafo tercero, debe interpretarse en el sentido de que un órgano jurisdiccional cuyas decisiones no son susceptibles de ulterior recurso judicial de Derecho interno debe remitir al Tribunal de Justicia de la Unión Europea...
