1) a) ¿Constituye la extradición de un Estado miembro a un tercer país una materia que, independientemente de las circunstancias del caso concreto, nunca está comprendida en el ámbito material de aplicación de los Tratados, de manera que no se ha de tener en cuenta el principio de no discriminación que rige en el Derecho de la Unión con arreglo al artículo 18 TFUE, párrafo primero, al aplicar (literalmente) una norma constitucional (en este caso, el artículo 16, apartado 2, primera frase, de la Constitución alemana (Grundgesetz, en lo sucesivo, «GG»), que prohíbe solamente la extradición de los propios nacionales a terceros países
b) En caso de respuesta afirmativa a la cuestión anterior: ¿Debe darse una respuesta diferente a la primera cuestión si la extradición de un Estado miembro a los Estados Unidos de América se basa en el Acuerdo de Extradición entre la Unión Europea y los Estados Unidos de América
2) En la medida en que no esté excluida de antemano la aplicación de los Tratados a la extradición de los Estados miembros a los Estados Unidos de América: ¿Deben interpretarse el artículo 18 TFUE, párrafo primero, y la jurisprudencia del Tribunal de Justicia de la Unión Europea al respecto en el sentido de que un Estado miembro infringe injustificadamente el principio de no discriminación establecido en el artículo 18 TFUE, párrafo primero, cuando, basándose en una norma constitucional (en este caso, el artículo 16, apartado 2, primera frase, de la GG), trata de forma diferente en cuanto a las solicitudes de extradición a los propios nacionales y a los nacionales de otros Estados miembros, al extraditar sólo a estos últimos
3) En el supuesto de que en los casos anteriores exista una infracción del principio general de no discriminación que establece el artículo 18 TFUE, párrafo primero...
