Pretensiones de la parte recurrente
- Que se anule la sentencia del Tribunal General de 9 de julio de 2010 el asunto T-237/05, Odile Jacob SAS/Comisión, en la medida en que ha anulado la decisión de la Comisión de 7 de abril de 2005 por la que ésta había denegado el acceso a determinados documentos relativos al procedimiento de control de la operación de concentración n o COMP/M.2978.
- Que se desestime el recurso de anulación interpuesto ante el Tribunal General por la parte recurrida en casación y que el Tribunal de Justicia resuelva definitivamente sobre las cuestiones que son objeto del presente recurso de casación.
- Que se condene a la demandante en primera instancia al pago de las costas en que haya incurrido la Comisión, tanto en primera instancia como en el presente recurso de casación.
Motivos y principales alegaciones
La Comisión invoca dos motivos en apoyo de su recurso de casación.
En su primer motivo de casación, la recurrente alega que el Tribunal General ha cometido un error de interpretación del Reglamento n o 1049/2001 ( 1
) al omitir tomar en consideración las disposiciones del Reglamento n o 4064/89, sobre las operaciones de concentración entre empresas ( 2 ), a efectos de interpretar las excepciones al derecho de acceso a los documentos. En efecto, a juicio de la Comisión, las normas generales sobre el derecho de acceso a los documentos deben tener en cuenta las características específicas de los procedimientos en materia de competencia y las garantías de confidencialidad que se ofrecen a las empresas interesadas en una operación de concentración.
En su segundo motivo de casación, que consta de cinco partes, la Comisión denuncia una interpretación errónea del artículo 4, apartados 2 y 3, del citado Reglamento n o 1049/2001 por parte del Tribunal General, en la medida en que éste ha estimado que la recurrente se encontraba obligada a proceder a un examen concreto e individual de todos los documentos a que se refería la solicitud de acceso, incluso en los supuestos manifiestamente cubiertos por una excepción (primera parte del motivo).
