AUDIOVISUAL POLICY : COMMISSION PLANS TO REVISE RULES ON STATE AID.

The European Commission plans to revise the rules on the funding of public service broadcasting in the EU. Before presenting any initiative, it invites member states and interested parties to give their opinion by 10 March 2008. After analysis, it could make, "if the case arises," proposals in the second half of the year, for adoption by summer 2009.

"The development of markets under the effect of digitisation and media convergence makes necessary an attentive analysis and a possible development of the rules," says the communication published on 10 January. In practice, it is a matter of updating the communication on broadcasting adopted in 2001.

The major principles defined in Community law remain the base of its work. Those guarantee "a large room for manoeuvre" to member states in the definition, organisation and funding of public service broadcasts. Furthermore, "the Commission admits that the mission of public service is defined broadly, including sport and entertainment as elements, to supply a balanced and varied schedule," specifies the document.

Following the 2001 communication, member states must also define "clearly and precisely the obligations of public service broadcasting". That means, reiterates the Commission, that "public service missions must be clearly defined and public (financial) support limited to what is necessary". The EU executive is therefore proceeding with the examination of possible disproportionate effects on competition, particularly produced though overcompensation and cross-subsidies for the benefit of commercial activities.
