Partes en el procedimiento principal Demandante: Ministerio Público Demandadas: Daniel Pierre Raymond Escalier (C-260/06) y Jean Louis François Bonnarel (C-261/06) Cuestión prejudicial 'Cuando un Estado miembro supedita la importación de un producto fitofarmacéutico, procedente de otro Estado miembro en el que el producto dispone ya de una autorización de comercialización expedida conforme a la Directiva 91/414/CEE, (1 ) a un procedimiento simplificado de autorización de comercialización, para verificar que el producto importado cumple los requisitos de identidad establecidos en la sentencia de 11 de marzo de 1999, The Queen/Ministry of Agriculture (C-100/96, Rec. p. I-1499), ¿está legitimado ese Estado miembro para imponer dicho procedimiento de autorización simplificada a un operador cuando:
-- el importador es un agricultor que importa el producto únicamente para las necesidades de su explotación agrícola, que son múltiples pero limitadas en cuanto a cantidad y, en consecuencia, no lleva a cabo su comercialización en el sentido mercantil que implica dicho concepto;
-- el procedimiento simplificado de AC, equivalente a una autorización de importación, es personal para cada operador o distribuidor, obligado a designar el producto importado con su propia marca, y está sujeto a un impuesto de 800 euros? En caso de respuesta negativa a esta primera cuestión, ¿puede extrapolarse la sentencia dictada el 26 de mayo de 2005 en el asunto C-212/03, relativa a las importaciones personales de medicamentos por particulares, a los supuestos de productos fitofarmacéuticos importados por los agricultores exclusivamente para las necesidades de sus explotaciones agrícolas?' (1 ) Directiva 91/414/CEE del Consejo, de 15 de julio de 1991, relativa a la comercialización de productos fitosanitarios (DO L 230, p. 1).
