Mediante su cuarto motivo, las recurrentes reprochan al Tribunal General que desestimara el quinto motivo del recurso y que confirmara las partes pertinentes de la Decisión en que la Comisión -infringiendo las Directrices para el cálculo del importe de las multas y los principios de equidad e igualdad de trato- denegó a KME el beneficio de una reducción de la multa por la aplicación de varias circunstancias atenuantes. Las recurrentes alegan, en particular, que el Tribunal General: 1) aplicó un criterio erróneo al evaluar si KME tenía derecho a una reducción de la multa por su aplicación limitada de los Acuerdos, 2) erró al desestimar la alegación de KME de que su multa debería haberse reducido por la crisis en la industria de los tubos de cobre para fontanería; y 3) no subsanó la denegación ilegal por parte de la Comisión de una reducción de la multa por la cooperación de KME fuera del marco de la Comunicación sobre la cooperación en relación con los acuerdos europeos más amplios, debido a que Outokumpu fue la primera empresa en proporcionar a la Comisión información sobre la duración total de esos acuerdos.
Mediante su quinto motivo, las recurrentes reprochan al Tribunal General que desestimara el séptimo motivo del recurso y confirmara la denegación de la Comisión de una reducción de la multa a KME por su incapacidad de pago. Las demandantes alegan que el Tribunal General incurrió en un error de Derecho al interpretar el requisito para la reducción de la multa por incapacidad de pago establecido en la Sección S, letra b), de las Directrices para el cálculo del importe de las multas, así como al no subsanar la discriminación ilegal cometida por la Comisión contra KME, en comparación con SGL Carbon en los asuntos sobre los grafitos especiales y los productos eléctricos y mecánicos de carbono y grafito. El Tribunal General además se basó en una motivación ilógica e insuficiente para desestimar las alegaciones de KME.
Mediante su sexto motivo, las recurrentes alegan que el Tribunal General infringió el Derecho de la Unión Europea y vulneró el derecho fundamental de las recurrentes a una tutela judicial completa y efectiva al no examinar atenta y concienzudamente las alegaciones de KME y mostrar una preferencia sesgada...
