Commission Directive

of 30 January 1979

on the second adaptation to technical progress of Council Directive 67/548/EEC on the approximation of laws, regulations and administrative provisions relating to the classification, packaging and labelling of dangerous substances

(79/370/EEC)

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community,

Having regard to Council Directive 67/548/EEC of 27 June 1967 on the approximation of laws, regulations and administrative provisions relating to the classification, packaging and labelling of dangerous substances [1], as last amended by Commission Directive 76/907/EEC [2], and in particular Articles 8a, 8b and 8c thereof,

Whereas Annex I to Directive 67/548/EEC contains a list dangerous substances, together with particulars of the labelling procedure in respect of each substance (danger symbol, nature of risks and safety advice);

Whereas examination of the list of dangerous substances has shown that this list needs to be adapted in the light of the latest scientific and technical knowledge or, more precisely, that it is necesary to change the classification and labelling of certain substances, to include new substances and to provide additional explanatory notes to that list;

Whereas Annexes III and IV to Directive 67/548/EEC contain statements of special risks (R-phrases) and safety advice (S-phrases); whereas certain specific risks have now been more precisely identified; whereas some of the safety advice phrases should be more clearly expressed; whereas, in these circumstances, Annexes III and IV should be amended;

Whereas the measures provided for in this Directive are in accordance with the opinion of the Committee for the Adaptation to Technical Progress of the Directive on the Removal of Technical Barriers to Trade in Dangerous Substances and Preparations,

HAS ADOPTED THIS DIRECTIVE:

Article 1

Directive 67/548/EEC is amended as follows:

1. The following Note D shall be added after Note C in the foreword to Annex I:

"Note D

Certain substances which are susceptible to spontaneous polymerization or decomposition are generally placed on the market in a stabilized form. It is in this form that they are listed in Annex I to this Directive. However, such substances are sometimes placed on the market in a non-stabilized form.

In this case, the manufacturer or any other person who places such a substance on the market must state on the label the name of the substance followed by the words "non-stabilized".

Example:

Methacrylic acid (non-stabilized)."
