La Commission note que l’Union dispose d’une compétence externe exclusive en matière d’indications géographiques et qu’elle adhère à l’acte de Genève de l’arrangement de Lisbonne en tant que partie à part entière, ainsi qu’il ressort de l’arrêt de la Cour de justice de l’Union européenne du 25 octobre 2017 (affaire C-389/15, Commission/Conseil). Étant donné la compétence externe exclusive de l’Union, les États membres ne sont pas autorisés à adhérer à l’acte de Genève en leur nom propre et ne devraient plus protéger eux-mêmes les indications géographiques nouvellement enregistrées par des pays tiers membres du système de Lisbonne. La Commission, eu égard aux circonstances exceptionnelles, étant donné que sept États membres sont depuis longtemps parties à l’arrangement de Lisbonne, au titre duquel ils ont déjà enregistré de nombreux droits de propriété intellectuelle, et qu’une transition sans heurts est nécessaire, aurait été disposée à accepter que, dans ce cas précis uniquement, la Bulgarie, la République tchèque, la Slovaquie, la France, la Hongrie, l’Italie et le Portugal soient autorisés à adhérer à l’acte de Genève dans l’intérêt de l’Union.
La Commission conteste fermement l’idée, avancée avec persistance par le Conseil, selon laquelle tous les États membres de l’Union qui le souhaitent pourraient être autorisés à ratifier l’acte de Genève ou à y adhérer parallèlement à l’Union, possibilité que le Conseil justifie par la régularisation des droits de vote de l’Union au regard de l’article 22, paragraphe 4, point b) ii), de l’acte de Genève plutôt que par les circonstances exceptionnelles précitées.
