DIRETTIVA DEL CONSIGLIO del 26 luglio 1971 per il ravvicinamento delle legislazioni degli Stati membri relative ai contatori di liquidi diversi dall'acqua (71/319/CEE)
IL CONSIGLIO DELLE COMUNITÀ EUROPEE,
visto il trattato che istituisce la Comunità economica europea, in particolare l'articolo 100,
vista la proposta della Commissione,
visto il parere del Parlamento europeo (1),
visto il parere del Comitato economico e sociale (2),
considerando che negli Stati membri la costruzione e la modalità di controllo dei contatori di liquidi formano oggetto di disposizioni cogenti che differiscono da uno Stato membro all'altro e ostacolano quindi gli scambi di tali strumenti ; che occorre pertanto procedere al ravvicinamento di tali disposizioni;
considerando che la direttiva del Consiglio del 26 luglio 1971 per il ravvicinamento delle legislazioni degli Stati membri relative alle disposizioni comuni agli strumenti di misura ed ai metodi di controllo metrologico (3) ha definito le procedure di approvazione CEE del modello e di verifica prima CEE ; che, conformemente a tale direttiva, occorre fissare per i contatori volumetrici di liquidi diversi dall'acqua le prescrizioni tecniche di realizzazione e di funzionamento;
considerando che, al fine di permettere l'utilizzazione immediata di tali strumenti in complessi di misurazione di liquidi, conviene procedere fin d'ora all'armonizzazione delle disposizioni nazionali riguardanti gli errori massimi tollerati su tali complessi,
HA ADOTTATO LA PRESENTE DIRETTIVA:
Articolo 1
La presente direttiva si applica ai contatori volumetrici di liquidi diversi dall'acqua, nei quali il liquido provoca il movimento delle pareti mobili delle camere di misurazione e che permettono di misurare dei volumi qualsiasi.
Articolo 2
1. Per contatore volumetrico di liquidi si intende uno strumento composto unicamente di un dispositivo misuratore e di un dispositivo indicatore. Esso fa generalmente parte di un complesso di misurazione.
2. Per complesso di misurazione di liquidi si intende uno strumento di misura comprendente, oltre al contatore stesso e ai dispositivi complementari che possono essergli associati, tutti i dispositivi necessari ad assicurare una misurazione corretta e, qualora esistano, i dispositivi che vengono aggiunti segnatamente per facilitare le operazioni. I complessi di misurazione formeranno oggetto di una direttiva particolare.
Articolo 3
I contatori volumetrici ai quali possono essere apposti i marchi e i contrassegni CEE sono descritti nel capitolo I dell'allegato. Essi formano oggetto di una approvazione CEE del modello e sono soggetti alla verifica prima CEE nelle condizioni definite nell'allegato II, punti 1 e 2, della direttiva per il ravvicinamento delle legislazioni degli Stati membri relative alle disposizioni comuni agli strumenti di misura ed ai metodi di controllo metrologico, e nelle condizioni che saranno definite dalla direttiva particolare relativa ai complessi di misurazione.
Articolo 4
Gli Stati membri non possono rifiutare, vietare o limitare l'immissione sul mercato e in servizio di contatori volumetrici di liquidi diversi dall'acqua muniti del contrassegno di approvazione CEE del modello e del marchio di verifica prima CEE.
