REGOLAMENTO (CE) N. 2116/2004 DEL CONSIGLIO

che modifica il regolamento (CE) n. 2201/2003 relativo alla competenza, al riconoscimento e all'esecuzione delle decisioni in materia matrimoniale e in materia di responsabilità genitoriale, che abroga il regolamento (CE) n. 1347/2000, rispetto ai trattati con la Santa Sede

IL CONSIGLIO DELL’UNIONE EUROPEA,

visto il trattato che istituisce la Comunità europea,

visto l'atto di adesione della Repubblica ceca, dell'Estonia, di Cipro, della Lettonia, della Lituania, dell'Ungheria, di Malta, della Polonia, della Slovenia e della Slovacchia, in particolare l'articolo 57, paragrafo 2,

vista la proposta della Commissione,

considerando quanto segue:

(1) L’articolo 40 del regolamento (CE) n. 1347/2000 del Consiglio, del 29 maggio 2000, relativo alla competenza, al riconoscimento e all’esecuzione delle decisioni in materia matrimoniale e in materia di potestà dei genitori sui figli di entrambi i coniugi (1) prevede che ogni decisione relativa all’invalidità di un matrimonio disciplinata dai trattati tra la Santa Sede e il Portogallo, l’Italia e la Spagna (Concordati) sia riconosciuta negli Stati membri alle condizioni di cui al capo III di detto regolamento.
(2) L’articolo 40 del regolamento (CE) n. 1347/2000 è stato modificato dall’allegato II dell’atto di adesione del 2003, al fine di menzionare l’accordo tra la Santa Sede e Malta, del 3 febbraio 1993, sul riconoscimento degli effetti civili dei matrimoni canonici e delle decisioni delle autorità e dei tribunali ecclesiastici in merito a tali matrimoni, con secondo protocollo aggiuntivo del 6 gennaio 1995.
