(2001/C 72 E/086) PREGUNTA ESCRITA P-1545/00 de Bart Staes (Verts/ALE) a la Comisión (10 de mayo de 2000) Asunto: Modificación de la Ley general de gastos extraordinarios de enfermedad (AWBZ) en los Países Bajos y libre circulación de personas en la UE En la respuesta a la pregunta escrita P-0706/00 (1 ) no se indica claramente si la modificación de la Ley general de gastos extraordinarios de enfermedad (AWBZ) en los Países Bajos es contraria o no a la libre circulación de personas en la Unión. Hasta no hace mucho, todos los ciudadanos neerlandeses estaban cubiertos por las disposiciones de la AWBZ. Sin embargo, a partir del 1 de enero de 2000 están excluidos de las prestaciones de la AWBZ los ciudadanos neerlandeses que residen en otros Estados miembros.
La decisión del Gobierno neerlandés de excluir a partir del 1 de enero de 2000 a los ciudadanos neerlandeses que residen en el extranjero de las prestaciones de la AWBZ, ¿es contraria al principio básico europeo relativo a la libre circulación de personas en la UE? En caso afirmativo, ¿qué medidas va a adoptar la Comisión para velar por que la AWBZ neerlandesa vuelva a ajustarse al principio básico europeo relativo a la libre circulación de personas en la Unión? En caso negativo, ¿qué argumentos (jurídicos) aduce la Comisión para afirmar que la ley AWBZ neerlandesa no infringe en absoluto el principio básico europeo relativo a la libre circulación de personas en la Unión?
