Respuesta (7 de noviembre de 2000) La interpretación de las disposiciones del Tratado no forma parte de las competencias del Consejo.
El Consejo reitera el principio acuñado por el Tribunal de Justicia según el cual la interpretación del Derecho comunitario no puede depender de los derechos nacionales. Los términos de una disposición de Derecho comunitario que no implica ninguna remisión expresa al Derecho de los Estados miembros para determinar su sentido y alcance deben ser objeto, normalmente, de una interpretación autónoma, que debe buscarse teniendo en cuenta el contexto de la disposición y la finalidad perseguida por la normativa de que se trate; a falta de remisión expresa, sólo cuando el juez comunitario no puede descubrir en el Derecho comunitario o en los principios generales de este Derecho los elementos que le permitan precisar el contenido y el alcance mediante una interpretación autónoma, la aplicación del Derecho comunitario puede implicar, en su caso, una referencia al Derecho de los Estados miembros (TPI, sentencia de 18 de diciembre de 1992, Díaz García/Parlamento, As. T-43/90, Rec. p. II-2619).
(2001/C 103 E/174) PREGUNTA ESCRITA E-2436/00 de Mario Mantovani (PPE-DE), Antonio Tajani (PPE-DE) y Stefano Zappalà (PPE-DE) al Consejo (24 de julio de 2000) Asunto: El sistema de espionaje 'Echelon' En la prensa italiana han aparecido noticias inéditas en relación con el sistema 'Echelon', creado por la Agencia Nacional de Seguridad (NSA) de los Estados Unidos, en colaboración con el Centro Gubernamental de Comunicaciones (GCHQ) británico, el CSE canadiense, el DSD australiano y el GCSB neozelandés, para interceptar todas las llamadas telefónicas, los faxes y los mensajes de correo electrónico enviados desde cualquier parte del mundo.
