DECISIÓN DEL CONSEJO
de 19 de abril de 2004
por la que se modifican los artículos 16 y 17 del Protocolo sobre el Estatuto del Tribunal de Justicia
(2004/404/CE, Euratom)
EL CONSEJO DE LA UNIÓN EUROPEA,
Visto el Tratado constitutivo de la Comunidad Europea, y en particular el párrafo segundo de su artículo 245, Visto el Tratado constitutivo de la Comunidad Europea de la Energía Atómica, y en particular el párrafo segundo de su artículo 160, Vista la petición del Tribunal de Justicia de 14 de noviembre de 2003, Visto el dictamen del Parlamento Europeo de 30 de marzo de 2004, Visto el dictamen de la Comisión de 16 de marzo de 2004, Considerando lo siguiente:
(1) Tras la entrada en vigor del Tratado relativo a la adhesión de la República Checa, la República de Estonia, la República de Chipre, la República de Letonia, la República de Lituania, la República de Hungría, la Repúblicade Malta, la República de Polonia, la República de Eslovenia y la República Eslovaca a la Unión Europea (1), el número de jueces que integrarán el Tribunal de Justicia pasará de quince a veinticinco, de conformidad con el párrafo primero del artículo 221, del Tratado constitutivo de la Comunidad Europea y con el párrafo primero del artículo 137 del Tratado constitutivo de la Comunidad Europea de la Energía Atómica.
(2) Procede, en consecuencia, adaptar el número de jueces que componen laGran Sala.
(3) Procede, además, adaptar el quórum exigido para las deliberaciones del Tribunal de Justicia reunido en Pleno.
DECIDE:
El Protocolo sobre el Estatuto del Tribunal de Justicia queda modificado como sigue:
1)En el párrafo segundo del artículo 16, el término 'once' se sustituye por el término 'trece'.
