DECISIÓN DE LA COMISIÓN de 10 de julio de 2003 por la que se modifica la Decisión 2001/338/CE relativa a determinadas medidas de protección respecto de los moluscos bivalvos procedentes u originarios de Perú [notificada con el número C(2003) 2290](Texto pertinente a efectos del EEE) (2003/509/CE) LA COMISIÓN DE LAS COMUNIDADES EUROPEAS,
Visto el Tratado constitutivo de la Comunidad Europea,
Vista la Directiva 97/78/CE del Consejo, de 18 de diciembre de 1997, por la que se establecenlos principios relativos a la organización de controles veterinarios de los productos que se introduzcan en la Comunidad procedentes de países terceros (1),
y, en particular, el apartado 1 de su artículo 22,
Considerando lo siguiente:
(1) A raíz de las deficiencias observadas, con ocasión de una inspección comunitaria en Perú, en cuanto a los controles de las condiciones sanitarias en la producción de moluscos bivalvos, la Comisión adoptó la Decisión 2001/338/CE (2), por la que se suspendía la importación de moluscos bivalvos procedentes u originarios de Perú,
a excepción de los pectínidos que cumplieran determinadas condiciones.
(2) La Decisión 2001/338/CE prevé la revisión de la misma en función de las garantías ofrecidas por las autoridades competentes de Perú y de los resultados de una inspección comunitaria in situ.
(3) En mayo de 2002 se realizó una visita de inspección comunitaria, y las autoridades competentes peruanas han aportado garantías satisfactorias en lo que respecta a la supervisión de las zonas de producción de La Mina/ Bahía Lagunilla e Isla Tortuga. Los resultados de la visita de inspección permiten concluir que las garantías ofrecidas por las autoridades peruanas son satisfactorias y que laimportación de pectínidos procedentes de las zonas propuestas podría autorizarse en las condiciones ya establecidas en la Decisión 2001/338/CE en relación con otras zonas acuícolas.
(4) En consecuencia, procede modificar oportunamente la Decisión 2001/338/CE.
(5) Las medidas propuestas en la presente Decisión se ajustan al dictamen del Comité permanente de la cadena alimentaria y de sanidad...
