DECISIÓN DE LA COMISIÓN
de 26 de abril de 2004
por la que se permite a los Estados miembros ampliar las autorizaciones provisionales concedidas a la nueva sustancia activa profoxidim

LA COMISIÓN DE LAS COMUNIDADES EUROPEAS,
Visto el Tratado constitutivo de la Comunidad Europea,
Vista la Directiva 91/414/CEE del Consejo, de 15 de julio de 1991, relativa a la comercialización de productos fitosanitarios (1), y, en particular, el cuarto párrafo del apartado 1 de su artículo 8,
Considerando lo siguiente:
(1) De conformidad con el apartado 2 del artículo 6 de la Directiva 91/414/CEE, España recibió en marzo de 1998 una solicitud de BASF AG para la inclusión de la sustancia activa profoxidim (antigua denominación:
clefoxidim, BAS 625H) en el anexo I de la Directiva 91/ 414/CEE. Mediante la Decisión 1999/43/CE (2), se confirmó que el expediente estaba documentalmente conforme y podía considerarse que satisfacía en principio los requisitos de información establecidos en los anexos II y III de la Directiva.
(2) Dicha confirmación de la conformidad documental del expediente era necesaria parapermitir su examen detallado y ofrecer a los Estados miembros la posibilidad de conceder autorizaciones provisionales, por un periodo de hasta tres años, para productos fitosanitarios que contuvieran profoxidim, de acuerdo con las condiciones establecidas en el apartado 1 del artículo 8 de la Directiva 91/414/CEE y, especialmente, con la de proceder a una evaluación detallada de la sustancia activa y del producto fitosanitario en relación con los requisitos dispuestos en la Directiva.
(3) Los efectos del profoxidim sobre la salud humana y el medio ambiente se han evaluado de acuerdo con lo dispuesto en los apartados 2 y 4 del artículo 6 de la Directiva 91/414/CEE, en lo relativo a los usos propuestos por el solicitante. El Estado miembro ponente presentó a la Comisión el proyecto de informe de evaluación el 28 de marzo de 2001.
