El mecanismo defensivo temporal estaba limitado en el tiempo y en su ámbito de aplicación. Los segmentos que podían recibir ayuda en el marco de la propuesta eran aquellos que, según la investigación de la Comisión sobre las prácticas de Corea en el sector de la construcción naval, sufrían considerables daños y perjuicios provocados por las prácticas desleales de Corea (la Comisión había realizado esta investigación de conformidad con el Reglamento (CE) no 3286/94 del Consejo, de 22 de diciembre de 1994, por el que se establecen procedimientos comunitarios en el ámbito de la política comercial común con objeto de asegurar el ejercicio de los derechos de la Comunidad en virtud de las normas comerciales internacionales, particularmente las establecidas bajo los auspicios de la Organización Mundial del Comercio (2 ), en lo sucesivo Reglamento sobre barreras comerciales (RBC)). Por consiguiente, la ayuda en el marco del mecanismo defensivo temporal se habría limitado a los buques portacontenedores y a los buques cisterna para el transporte de productos y sustancias químicas.
En noviembre de 2001, la industria de construcción naval de la Comunidad pidió a la Comisión que actualizase la investigación llevada a cabo en el marco del RBC en lo relativo a los daños. Una vez que se haya llevado a cabo esta investigación, sus resultados serán presentados al Consejo (Comité RBC). En cuanto a la situación actual, la Comisión puede confirmar que sólo se llevará a cabo una revisión de la propuesta si así lo justificasen los resultados del informe sobre el RBC actualizado.
