Recurso interpuesto el 21 de noviembre de 2005 contra la República Helénica por la Comisión de las Comunidades Europeas (Asunto C-409/05) (2006/C 10/31) (Lengua de procedimiento: griego) En el Tribunal de Justicia de las Comunidades Europeas se ha presentado el 21 de noviembre de 2005 un recurso contra República Helénica formulado por la Comisión de las Comunidades Europeas, representada por los Sres. D. Triantafyllou,
Consejero jurídico, y G. Wilms, miembro de su Servicio Jurídico, que designa domicilio en Luxemburgo.
La parte demandante solicita al Tribunal de Justicia que:
-- Declare que la República Helénica ha incumplido las obligaciones que le incumben en virtud de los artículos 2, 9, 10 y 11 del Reglamento 1552/89, (1 ) hasta el 31 de mayo de 2000, y de los artículos correlativos del Reglamento 1150/2000, (2 ) a partir de esa fecha, al haberse negado a calcular y a abonar los recursos propios de las Comunidades derivados de la importación de material militar exento del pago de derechos de aduana y al haberse negado a pagar los intereses de demora que resultan de la omisión del reembolso de dichos recursos a la Comisión.
-- Condene en costas a la parte demandada.
Motivos y principales alegaciones -- La parte demandada no ha demostrado que el pago de derechos de aduana a un tipo reducido (o tipo cero) perjudique esencialmente la defensa del país en el sentido del artículo 296 CE.
-- El secreto militar no dispensa de la obligación primaria de calcular y devolver los correspondientes derechos de aduana.
-- La parte demandada no puede invocar la protección de la confianza legítima derivada de una incoación tardía del procedimiento.
-- El incumplimiento de las obligaciones de contribuir económicamente a la Comunidad ocasiona una carga injusta a los demás Estados miembros.
