che modifica il regolamento (CE) n. 2037/2000, per quanto concerne il controllo dell'halon esportato per usi critici, l'esportazione di prodotti e apparecchiature contenenti clorofluorocarburi e i controlli sul bromoclorometano
IL PARLAMENTO EUROPEO E IL CONSIGLIO DELL'UNIONE EUROPEA,
visto il trattato che istituisce la Comunità europea, in particolare l'articolo 175, paragrafo 1,
vista la proposta della Commissione(1),
visto il parere del Comitato economico e sociale europeo(2),
previa consultazione del Comitato delle regioni,
deliberando secondo la procedura di cui all'articolo 251 del trattato(3),
considerando quanto segue:
(1) Nell'applicazione del regolamento (CE) n. 2037/2000 del Parlamento europeo e del Consiglio del 29 giugno 2000 sulle sostanze che riducono lo strato di ozono(4), è emersa una serie di problemi che vanno affrontati apportando modifiche a tale regolamento. Tali problemi, relativi ad un'efficace e sicura attuazione di tale regolamento, sono stati discussi con gli Stati membri in sede di comitato di gestione di tale regolamento. Il presente regolamento riguarda quattro modifiche al regolamento (CE) n. 2037/2000.
(2) Ai sensi dell'articolo 4, paragrafo 4, punto iv), del regolamento (CE) n. 2037/2000 la Commissione è incaricata di riesaminare ogni anno gli usi critici di halon elencati nell'allegato VII di tale regolamento. Tuttavia, detto regolamento non prevede che in sede di riesame siano fissati termini per la graduale eliminazione degli usi critici in seguito all'individuazione e all'introduzione di opportune alternative. La prima modifica a detto regolamento prevede la possibilità di stabilire i termini entro i quali deve essere ridotto l'impiego degli halon per usi critici, tenuto conto della disponibilità di alternative o di tecnologie tecnicamente ed economicamente praticabili che siano accettabili dal punto di vista ambientale e sanitario in sede di revisione dell'allegato VII di tale regolamento. Ciò dovrebbe assicurare che si compiano progressi nel ridurre i quantitativi di halon impiegati per usi critici e accelerare così il ripristino dello strato di ozono.
(3) La seconda modifica riguarda le esportazioni di halon per gli usi critici elencati nell'allegato VII del regolamento (CE) n. 2037/2000. Dal 1o gennaio 2004 tale regolamento consentirà che soltanto l'halon impiegato per gli scopi elencati nel suo allegato VII resti in uso per l'estinzione degli incendi nella Comunità europea. Detti usi sono ritenuti "critici" in quanto attualmente privi di alternative tecnicamente ed economicamente praticabili. Qualunque attrezzatura contenente halon diversa da quelle elencate nell'allegato VII è quindi ritenuta non critica. Tutti gli impianti in cui l'halon è impiegato per usi non critici, dovrebbero essere eliminati entro il 31 dicembre 2003 e l'halon estratto dovrebbe poter essere immagazzinato per usi critici o esportato da impianti di immagazzinamento per usi critici, oppure distrutto.
(4) L'articolo 11, paragrafo 1, lettera d), del regolamento (CE) n. 2037/2000 autorizza "l'esportazione di prodotti e di apparecchiature contenenti halon, per soddisfare gli usi critici di cui all'allegato VII". Tale articolo dovrebbe essere modificato in modo da consentire l'esportazione di halon sfuso per usi critici entro il 31 dicembre 2009 ove esso sia ottenuto da halon recuperato, riciclato o rigenerato che provenga da impianti di immagazzinamento autorizzati o gestiti dall'autorità competente. Dovrebbe essere previsto un riesame delle esportazioni di halon sfuso per usi critici al fine di vietarne, se del caso, l'esportazione prima del 31 dicembre 2009. Dovrebbero essere vietate le esportazioni di halon per usi critici dopo il 31 dicembre 2003 se l'halon non proviene da impianti autorizzati o gestiti dall'autorità competente per immagazzinare halon per usi critici.
