Esta decisión, aunque loable, ha recibido críticas por no ajustarse a la Convención Internacional de Derecho del Mar. Su artículo 58 establece la libertad de navegación y de sobrevuelo en ese espacio de la Zona Económica Exclusiva, donde sí cabe una restricción a esta libre circulación, pero por parte de la OMI y no de manera unilateral por uno o varios Estados.
¿Qué opinión le merece a la Comisión esta declaración de los Gobiernos de España y de Francia? Compartiendo la necesidad de reducir los riesgos de nuevas catástrofes, ¿va a instar la Comisión a los Estados miembros a que, conforme al apartado sexto del artículo 211 de la Convención sobre el Derecho del Mar, dirijan una comunicación motivada a la Organización Marítima Internacional solicitando autorización para restringir el libre tránsito de estos buques en esta zona determinada? (2003/C 192 E/127) PREGUNTA ESCRITA E-3657/02 de Rosa Miguélez Ramos (PSE) a la Comisión (18 de diciembre de 2002) Asunto: Marea negra en Galicia: alejamiento del Corredor de Finisterre La opinión pública europea está muy preocupada por los riesgos a los que está sometido su litoral debido al tránsito de petroleros que transportan mercancías altamente contaminantes a poca distancia de la costa.
Asistimos a una globalización en la que la parte oscura, en la que se cometen todo tipo de abusos, como explotación de trabajadores y atentados contra el medio ambiente, es mayor que la parte regulada por las organizaciones internacionales y los Estados. El 60 % de la flota mercante mundial navega bajo pabellones de conveniencia.
Por ejemplo, el corredor de Finisterre, establecido a 25 millas de la costa, soporta un tráfico anual de 65 000 buques mercantes, 6 000 de los cuales con mercancías peligrosas, lo que arroja un saldo de un 'Prestige' cada hora y media.
¿Piensa presentar la Comisión alguna propuesta destinada a establecer nuevos corredores marítimos más alejados de la costa, de manera que se reduzca el riesgo de nuevas mareas negras?
