Cuestiones prejudiciales
1) ¿Se ha de interpretar el artículo 3, apartado 1, letra b) [del Reglamento (CE) no 2201/2003] (1), en el sentido de que debe hacer prevalecer la nacionalidad del tribunal que conoce del litigio, en el caso de que los cónyuges posean a la vez la nacionalidad del Estado del tribunal que conoce del litigio y la nacionalidad de otro Estado miembro de la Unión Europea?
2) Si la respuesta a la anterior cuestión es negativa, ¿debe interpretarse dicha disposición en el sentido de que, cuando los cónyuges poseen cada uno dos nacionalidades, de los dos mismos Estados miembros, aquélla designa la nacionalidad más efectiva de ambas nacionalidades?
3) Si la respuesta a la anterior cuestión es negativa, ¿hay que considerar que dicha disposición ofrece a los cónyuges una opción adicional, consistente en que pueden a su elección ejercer la acción ante uno u otro de los tribunales de los dos Estados cuya nacionalidad poseen ambos cónyuges?

El plazo para la adaptación del Derecho interno a la Directiva expiró el 15 de abril de 2006.
