Anuncio de conformidad con el artículo 19, apartado 1, del Reglamento (CE) no 980/2005 del Consejo por el que se inicia una investigación en relación con la protección de la libertad sindical y el derecho de sindicación en El Salvador

El 31 de marzo de 2008, la Comisión adoptó la Decisión 2008/316/CE por la que se inicia una investigación de conformidad con lo establecido en el artículo 18, apartado 2, del Reglamento (CE) no 980/2005 del Consejo, en relación con la protección de la libertad sindical y el derecho de sindicación en El Salvador (DO L 108 de 18.4.2008, p. 29). La investigación determinará si la legislación nacional de la República de El Salvador ha dejado de incorporar el Convenio no 87 sobre la libertad sindical y la protección del derecho de sindicación de la Organización Internacional del Trabajo, o si esta legislación no se aplica de manera efectiva.
De conformidad con el artículo 18 del Reglamento (CE) no 980/2005 del Consejo, de 27 de junio de 2005, relativo a la aplicación de un sistema de preferencias arancelarias generalizadas (1), en caso de que la Comisión reciba información y considere que existen motivos suficientes para realizar una investigación que pueda justificar la retirada temporal, puede decidir iniciar una investigación.
Se ha comunicado a la Comisión que el Tribunal Supremo de El Salvador, en su sentencia de 28 de octubre de 2007 en los casos 63-2007 y 69-2007, declaró que algunas disposiciones del Convenio no 87 sobre la libertad sindical y la protección del derecho de sindicación de la Organización Internacional del Trabajo eran incompatibles con el artículo 47 de la Constitución de El Salvador.
