EL COMITÉ POLÍTICO Y DE SEGURIDAD,
Visto el Tratado de la Unión Europea, y en particular su artículo 38,
Vista la Acción Común 2008/851/PESC del Consejo, de 10 de noviembre de 2008, relativa a la Operación Militar de la Unión Europea destinada a contribuir a la disuasión, prevención y la represión de los actos de piratería y del robo a mano armada frente a las costas de Somalia (1), y en particular su artículo 6,
Considerando lo siguiente:
(1) En virtud del artículo 6, apartado 1, de la Acción Común 2008/851/PESC, el Consejo autorizó al Comité Político y de Seguridad (CPS) a adoptar las decisiones relativas al nombramiento del comandante de la Fuerza de la UE para la Operación Militar de la Unión Europea destinada a contribuir a la disuasión, prevención y represión de los actos de piratería y del robo a mano armada frente a las costas de Somalia («comandante de la Fuerza de la UE»).
(2) El 3 de julio de 2014, el CPS adoptó la Decisión 2014/433/PESC (2) por la que se nombra al general de división Martin SMITH comandante de la operación de la UE.
(3) El Reino Unido ha propuesto al general de brigada Robert A. MAGOWAN para sustituir al general de división Martin SMITH como comandante de la operación de la UE.
(4) El Comité Militar apoya dicha propuesta.
(5) De conformidad con el artículo 5 del Protocolo n.o 22 sobre la posición de Dinamarca, anejo al Tratado de la Unión Europea y al Tratado de Funcionamiento de la Unión Europea, Dinamarca no participa en la elaboración y aplicación de decisiones y acciones de la Unión con implicaciones en el ámbito de la defensa.
