Although 5 December 2011marked the end of the transitory period granted to member states to apply the directive on temporary agency work, Eurociett, the European Confederation of Private Employment Agencies, is concerned by the unbalanced implementation of the text. According to Eurociett, "where implementation has occurred it has shown to be mostly unbalanced".

Directive 2008/104/EC establishes the equal treatment of interim workers on essential conditions of work and employment, namely with regard to the duration of work and with regard to payment. The directive was adopted at the end of 2008 by Parliament and Council and the deadline for complete implementation by all member states was 5 December 2011. Yet, according to the Eurociett, the lifting of unjustified restrictions in the sector of temporary work, which should have followed, is still pending.
