1) El artículo 1, apartado 1, el artículo 2, apartado 1, letra b), y el artículo 6, apartado 1, de la Directiva 2006/115/CE del Parlamento Europeo y del Consejo, de 12 de diciembre de 2006, sobre derechos de alquiler y préstamo y otros derechos afines a los derechos de autor en el ámbito de la propiedad intelectual, deben interpretarse en el sentido de que el concepto de «préstamo», enunciado en esas disposiciones, abarca el préstamo de una copia de un libro en forma digital, cuando ese préstamo se realiza cargando dicha copia en el servidor de una biblioteca pública y permitiendo que el usuario interesado la reproduzca por descarga en su propio ordenador, entendiéndose que sólo puede descargarse una copia durante el período de duración del préstamo y que una vez transcurrido ese período la copia descargada por ese usuario deja de ser utilizable por éste.
2) El Derecho de la Unión, y en particular el artículo 6 de la Directiva 2006/115, debe interpretarse en el sentido de que no se opone a que un Estado miembro someta la aplicación del artículo 6, apartado 1, de la Directiva 2006/115 a la condición de que la copia de un libro en...
