Asunto T-122/14: Recurso interpuesto el 19 de febrero de 2014 — Italia/Comisión

La parte demandante solicita al Tribunal General que:

Anule la Decisión impugnada.
—
Condene en costas a la Comisión Europea.
El presente recurso se dirige contra la Decisión C(2013) 8681 final de 9 de diciembre de 2013, con la cual, en cumplimiento de la sentencia del Tribunal de Justicia de 17 de noviembre de 2011, dictada en el asunto C-496/09, la Comisión requirió a la República Italiana el pago de una cantidad de 6 252 000 euros en concepto de demora.
La decisión impugnada se refiere al segundo semestre de retraso y, por tanto, al período comprendido entre el 17 de mayo y el 17 de noviembre de 2012.
El Gobierno italiano invoca los siguientes motivos de recurso:
1)
Primer motivo, basado en la infracción del artículo 260 TFUE, apartados 1 y 3, párrafo 2, así como en la vulneración de la sentencia objeto de ejecución, en relación con los créditos contra las empresas en convenio concursal o en administración controlada.
A este respecto se alega que la decisión, en efecto, no detrae de la ayuda suspendida al vencimiento del mes de referencia, los créditos hacia las empresas deudoras en estado de quiebra o sujetas a procedimientos concursales, mencionados en el pasivo de los procedimientos relativos, aunque, en opinión del Gobierno italiano, se trata de créditos para cuya recuperación el Estado miembro ha actuado con la mayor diligencia posible y, en consecuencia, debían quedar excluidos de las ayudas suspendidas con arreglo a lo establecido en la sentencia que debe ejecutarse.
2)
Segundo motivo, basado en la infracción del artículo 14 del Reglamento (CE) no 659/1999 del Consejo, de 22 de marzo de 1999, por el que se establecen disposiciones de aplicación del artículo 93 del Tratado CE (DO L 83, p. 1), y en la aplicación errónea del artículo 11 del Reglamento (CE) no 794/2004 de la Comisión, de 21 de abril de 2004, por el que se establecen disposiciones de aplicación del Reglamento(CE) no 659/1999 del Consejo por el que se establecen disposiciones de aplicación del artículo 93 del Tratado CE (DO L 140, p. 1).
