25. Finalmente, la Comisión observa que, tras una decisión negativa de la Comisión sobre una ayuda en forma de crédito fiscal a los astilleros españoles públicos (11), los astilleros en cuestión no han devuelto la ayuda. En el supuesto de que la Comisión en su decisión final sobre este caso tuviese motivos para autorizar la prórroga del plazo de 3 años para alguno de los tres buques gaseros, además, tendría que evaluar la pertinencia de la sentencia Deggendorf (12) si todavía no se hubiera devuelto la ayuda previamente mencionada.
4. Conclusión 26. Habida cuenta de las consideraciones expuestas, la Comisión ha decidido iniciar el procedimiento del apartado 2 (11) Decisión 2000/131/CE (DO L 37 de 12.2.2000, p. 22).

27. La Comisión requiere a España para que, en un plazo de 1 mes a partir de la recepción de la presente, le facilite toda la información necesaria para evaluar la compatibilidad de la ayuda. Insta a sus autoridades para que transmitan inmediatamente una copia de la presente carta al beneficiario potencial de la ayuda.
28. La Comisión desea recordar a España el efecto suspensivo del apartado 3 del artículo 88 del Tratado CE y llama su atención sobre el artículo 14 del Reglamento (CE) no 659/1999 del Consejo, que prevé que toda ayuda concedida ilegalmente podrá recuperarse de su beneficiario.'.
