modifiant la directive 91/414/CEE du Conseil, en vue d'y inscrire les substances actives acide benzoïque, flazasulfuron et pyraclostrobine

LA COMMISSION DES COMMUNAUTÉS EUROPÉENNES,

vu le traité instituant la Communauté européenne,

vu la directive 91/414/CEE du Conseil du 15 juillet 1991 concernant la mise sur le marché des produits phytopharmaceutiques(1), et notamment son article 6, paragraphe 1,

considérant ce qui suit:

(1) Conformément à l'article 6, paragraphe 2, de la directive 91/414/CEE, l'Allemagne a reçu, de Menno Chemie Vertriebsgesellschaft, le 25 mai 1998, une demande d'inscription de la substance active acide benzoïque à l'annexe I de la directive précitée. Par la décision 98/676/CE de la Commission(2), il a été confirmé que le dossier était "conforme", c'est-à-dire qu'il pouvait être considéré comme satisfaisant, en principe, aux exigences en matière de données et d'informations prévues aux annexes II et III de la directive 91/414/CEE.

(2) L'Espagne a reçu, le 16 décembre 1996, une demande au titre de l'article 6, paragraphe 2, de la directive 91/414/CEE, de ISK Biosciences Europe SA concernant le flazasulfuron. Cette demande a été déclarée conforme par la décision 97/865/CE de la Commission(3).

(3) L'Allemagne a reçu, le 28 février 2000, une demande au titre de l'article 6, paragraphe 2, de la directive 91/414/CEE, de BASF AG concernant la pyraclostrobine (ancienne dénomination: BAS 500F). Cette demande a été déclarée conforme par la décision 2000/540/CE de la Commission(4).

(4) Les effets de ces substances actives sur la santé humaine et l'environnement ont été évalués conformément aux dispositions de l'article 6, paragraphes 2 et 4, de la directive 91/414/CEE pour les utilisations proposées par les demandeurs. Les États membres rapporteurs désignés ont soumis à la Commission des projets de rapports d'évaluation concernant les substances, respectivement le 22 novembre 2000 (acide benzoïque), le 1er août 1999 (flazasulfuron) et le 23 novembre...
