Decisión de la Autoridad para los partidos políticos europeos y las fundaciones políticas europeas, de 20 de septiembre de 2017, por la que se registra a New Direction-La Fundación para Reformas Europeas

LA AUTORIDAD PARA LOS PARTIDOS POLÍTICOS EUROPEOS Y LAS FUNDACIONES POLÍTICAS EUROPEAS,

Visto el Tratado de Funcionamiento de la Unión Europea,

Visto el Reglamento (UE, Euratom) n.o 1141/2014 del Parlamento Europeo y del Consejo, de 22 de octubre de 2014, sobre el estatuto y la financiación de los partidos políticos europeos y las fundaciones políticas europeas (1), y en particular su artículo 9,

Vista la solicitud presentada por New Direction-La Fundación para Reformas Europeas,

Considerando lo siguiente:

(1) El 5 de septiembre de 2017, la Autoridad para los partidos políticos europeos y las fundaciones políticas europeas (l«Autoridad») recibió de New Direction-La Fundación para Reformas Europeas («solicitante») una solicitud de registro como fundación política europea en virtud del artículo 8, apartado 1, del Reglamento (UE, Euratom) n.o 1141/2014, así como una versión revisada de parte de dicha solicitud el 14 de septiembre de 2017.

(2) El solicitante presentó documentación que certifica que reúne los requisitos establecidos en el artículo 3 del Reglamento (UE, Euratom) n.o 1141/2014, la declaración según el formulario que figura en el anexo de dicho Reglamento, y sus estatutos, que contienen las disposiciones previstas en el artículo 5 del mencionado Reglamento.

(3) En apoyo de la solicitud también se presentó una declaración del notario Pieter Herman, con arreglo al artículo 15, apartado 2, del Reglamento (UE, Euratom) n.o 1141/2014, por la que se certifica que el solicitante tiene su sede en Bélgica y que sus estatutos son conformes con las disposiciones pertinentes del Derecho nacional.

(4) El solicitante presentó otros documentos con arreglo a los artículos 1 y 2 del Reglamento Delegado (UE, Euratom) 2015/2401 de la Comisión (2).

(5) De conformidad con el artículo 9 del Reglamento (UE, Euratom) n.o 1141/2014, la Autoridad ha examinado la solicitud y la documentación que la acompaña, y considera que el solicitante cumple los requisitos de registro que establece el artículo 3 de dicho Reglamento, y que los estatutos incluyen las disposiciones previstas en el artículo 5 del mencionado Reglamento.

HA ADOPTADO LA PRESENTE DECISIÓN:

Mediante la presente Decisión se registra a New Direction-La Fundación para Reformas Europeas como fundación política europea.

Adquirirá personalidad jurídica europea en la fecha de publicación de la presente Decisión en el Diario Oficial de la Unión Europea.

La presente Decisión surtirá efecto el día de su notificación.

1. ‘New Direction – The Foundation for European Reform FPEU’ (hereafter referred to as ‘The Foundation’) is a European political foundation that does not pursue profit goals, is an entity which: (i) is formally affiliated with The Alliance of Conservatives and Reformists in Europe (hereafter referred to as ‘ACRE’), which (ii) is registered with the Authority for European Political Parties and Foundations (‘Authority’) in accordance with the conditions and procedures laid down in Regulation Number 1141/2014 (‘the Regulation’) of the European Parliament and of The Council of 22 October 2014 on the statute and funding of European political parties and European political foundations, and the provisions of Title I, Chapter I, and of Title III quater of the Belgian Act of 27 June 1921 regarding non-profit associations, international non-profit associations and foundations, European political parties and European political foundations (‘the Act’). The Foundation has legal personality in accordance with ‘the Regulation’ and ‘the Act’.

2. The name of the Foundation in its official languages is at Annex I. The official logo of the Foundation is a blue polygon lion and outlined in the Internal Regulations.

3. The official language of the Foundation are the official languages of the Member States of the constituent parties.

4. The registered office of the Foundation is established at Rue du Trone 4, Brussels 1000, Belgium. The registered office may be transferred to any other location in a EU Member State by a decision of the General Assembly.

5. The Foundation is a non-profit organization, which through its activities, within the aims and fundamental values pursued by the Union, underpins and complements the objectives of ACRE by performing one or more of the following tasks: — Providing decision-makers and opinion leaders with effective policy options based on the principles embodied in the Prague Declaration of the ECR Group of 30 March 2009 (Annex II) and ACRE's Reykavik Declaration (Annex III).

   — observing, analysing and contributing to the debate on European public policy issues and on the process of European integration;

   — developing activities linked to European public policy issues, such as organising and supporting seminars, training, conferences and studies on such issues between relevant stakeholders, including youth organisations and other representatives of civil society;

   — developing cooperation in order to promote democracy, including in third countries;

   — serving as a forum for like-minded national political foundations and think-tanks, academics, and other relevant actors to work together at European level.

   — encouraging strong transatlantic links.

6. The Foundation may carry out all operations and conduct all activities, which directly or indirectly increase or promote its aims and objectives, in accordance with the applicable legislation.

7. The Foundation is incorporated for an unlimited period of time.

8. Membership is open to individual and global members. The Foundation shall consist of individual and global members. Natural persons or legal entities lawfully established in accordance with the laws and customs of their country of origin can become global members.
