(1) El Acuerdo sobre la retirada del Reino Unido de Gran Bretaña e Irlanda del Norte de la Unión Europea y de la Comunidad Europea de la Energía Atómica (en lo sucesivo, «Acuerdo de Retirada»), celebrado mediante la Decisión (UE) 2020/135 del Consejo (1), entró en vigor el 1 de febrero de 2020.
(2) De conformidad con el artículo 171, apartado 1, del Acuerdo de Retirada, el Comité Mixto estableció al final del período transitorio una lista de veinticinco personas dispuestas y capaces para ejercer como miembros de un panel de arbitraje. El Comité Mixto ha de velar por que la lista cumpla los requisitos en todo momento.
(3) De conformidad con el artículo 171, apartado 2, del Acuerdo de Retirada, en la lista no deben figurar personas que sean miembros, funcionarios u otros agentes de las instituciones de la Unión, del gobierno de un Estado miembro o del gobierno del Reino Unido.
(4) Una de las personas propuestas por la Unión que figuran en la lista ha sido designada para el cargo de abogado general del Tribunal de Justicia y, por lo tanto, ha dejado de cumplir los requisitos para ser árbitro en virtud del Acuerdo de Retirada.
(5) Por consiguiente, es necesario sustituir a dicha persona por un candidato de la lista de reserva de candidatos dispuestos y capaces para ejercer como miembros designados por la Unión de un panel de arbitraje con arreglo al Acuerdo de Retirada, tal como figura en el anexo II de la Decisión (UE) 2020/2232 del Consejo (2).
(6) Procede establecer la posición que debe adoptarse en nombre de la Unión en el Comité Mixto.
