El análisis que figura a continuación se realiza conforme a las disposiciones de la Directiva (UE) 2016/797 del Parlamento Europeo y del Consejo, de 11 de mayo de 2016, sobre la interoperabilidad del sistema ferroviario dentro de la Unión Europea (1) y del Reglamento (UE) n.o 1301/2014 de la Comisión, de 18 de noviembre de 2014, sobre las especificaciones técnicas de interoperabilidad del subsistema de energía del sistema ferroviario de la Unión (2).
El 2 de febrero de 2018, la Comisión recibió de SNCF Réseau, de conformidad con el artículo 10 del Reglamento (UE) n.o 1301/2014, una solicitud de dictamen de la Comisión relativo a una solución innovadora para el diseño de la línea aérea de contacto con el fin de permitir velocidades operativas de hasta 360 km/h.
La propuesta de SNCF Réseau es ampliar de 320 km/h a 360 km/h el uso de la curva de la fuerza de contacto media a que se hace referencia en el punto 4.2.11 del Reglamento (UE) n.o 1301/2014.
A raíz de una solicitud de la Comisión para que evaluase la solución técnica propuesta por SNCF Réseau, el 16 de abril de 2018 la Agencia Ferroviaria de la Unión Europea (en lo sucesivo, «la Agencia») formuló un dictamen sobre la conformidad de la solución innovadora propuesta por SNCF Réseau para el diseño de la línea aérea de contacto con el fin de permitir velocidades operativas de hasta 360 km/h con los requisitos esenciales de la Directiva (UE) 2016/797.
