REGLAMENTO (CE) No 1249/2003 DE LA COMISIÓN de 11 de julio de 2003 relativo a la expedición de certificados de exportación del sistema A3 en el sector de las frutas y hortalizas (tomates, uvas de mesa, manzanas) LA COMISIÓN DE LAS COMUNIDADES EUROPEAS,
Visto el Tratado constitutivo de la Comunidad Europea,
Visto el Reglamento (CE) no 2200/96 del Consejo, de 28 de octubre de 1996, por el que se establece la organización común de mercado en el sector de las frutas y hortalizas (1),
cuya última modificación la constituye el Reglamento (CE) no 47/2003 de la Comisión (2), y, en particular, el tercer párrafo del apartado 3 de su artículo 35,
Considerando lo siguiente:
(1) El Reglamento (CE) no 1074/2003 de la Comisión (3) ha abierto una licitación en la que se fijan los tipos de restitución indicativos y las cantidades indicativas para los cuales se pueden expedir los certificados de exportación del sistema A3.
(2) En función de las ofertas presentadas, procede fijar lostipos máximos de restitución y los porcentajes de expedición para las cantidades en relación con las ofertas realizadas al nivel de dichos tipos máximos.
(3) En el caso de los tomates, las uvas de mesa y las manzanas, el tipo máximo necesario para la concesión de certificados hasta alcanzar la cantidad indicativa,
dentro del límite de las cantidades licitadas, no es superior a una vez y media el tipo de restitución indicativo.
HA ADOPTADO EL PRESENTE REGLAMENTO:
En lo que respecta a los tomates, las uvas de mesa y las manzanas, los tipos máximos de restitución y los porcentajes de expedición relativos a la licitación abierta por el Reglamento (CE) no 1074/2003 se fijan en el anexo del presente Reglamento.
El presente Reglamento entrará en vigor el 12 de julio de 2003.
