II (Actos cuya publicación no es una condición para su aplicabilidad) COMISIÓN DECISIÓN DE LA COMISIÓN de 18 de mayo de 2001 relativa al inventario del potencial de producción vitícola presentado por Alemania en virtud del Reglamento (CE) no 1493/1999 del Consejo [notificada con el número C(2001) 1432] (El texto en lengua alemana es el único auténtico) (2001/414/CE) LA COMISIÓN DE LAS COMUNIDADES EUROPEAS,
Visto el Tratado constitutivo de la Comunidad Europea,
Visto el Reglamento (CE) no 1493/1999 del Consejo, de 17 de mayo de 1999, por el que se establece la organización común del mercado vitivinícola (1 ), modificado por el Reglamento (CE) no 2826/2000 (2 ), y, en particular, el apartado 4 de su artículo 23,
Considerando lo siguiente:
(1) El Reglamento (CE) no 1493/1999 contempla en su artículo 16 la presentación de un inventario del potencial vitícola. La presentación de dicho inventario debe realizarse como pasivo previo al acceso a las medidas de regularización de las superficies plantadas ilegalmente, al aumento de los derechos de plantación y a la ayuda en favor de la reestructuración y de la reconversión.
(2) El Reglamento (CE) no 1227/2000 de la Comisión, de 31 de mayo de 2000, por el que se fijan las disposiciones de aplicación del Reglamento (CE) no 1493/1999 del Consejo por el que se establece la organización común del mercado vitivinícola, en lo relativo al potencial de producción (3 ) establece en su artículo 19 el nivel de detalle de las informaciones incluidas en el inventario.
(3) Alemania comunicó a la Comisión mediante cartas del 22 de septiembre de 2000 y 12 de diciembre de 2000 la información contemplada en el artículo 16 del Reglamento (CE) no 1493/1999. El examen de dichas informaciones permite comprobar que Alemania ha realizado efectivamente el inventario.
(4) La presente Decisión no implica el reconocimiento por parte de la Comisión de la exactitud de los datos incluidos en el inventario, ni de la compatibilidad de la legislación citadas en el inventario...
