SENTENCIA DEL TRIBUNAL DE JUSTICIA (Sala Sexta) de 30 de septiembre de 2004 en el asunto C-359/03: Comisión de las Comunidades Europeas contra República de Austria (1 ) (Incumplimiento de Estado -- Directiva 90/270/CEE -Protección de los trabajadores -- Trabajo con equipos que incluyen pantallas de visualización -- Disposiciones mínimas de seguridad y de salud -- No adaptación del Derecho interno) (2004/C 284/09) (Lengua de procedimiento: alemán) En el asunto C-359/03, que tiene por objeto un recurso por incumplimiento interpuesto, con arreglo al artículo 226 CE, el 19 de agosto de 2003, Comisión de las Comunidades Europeas (agentes: Sres. D. Martin y H. Kreppel) contra República de Austria (agente: Sr. E. Riedl), el Tribunal de Justicia (Sala Sexta), integrado por el Sr. J.-P. Puissochet, Presidente de Sala, y los Sres. S. von Bahr y A. Borg Barthet (Ponente), Jueces; Abogado General: Sr. D. Ruiz-Jarabo Colomer; Secretario: Sr. R. Grass, ha dictado el 30 de septiembre de 2004 una sentencia cuyo fallo es el siguiente:
1) Declarar que la República de Austria ha incumplido las obligaciones que le incumben en virtud de la Directiva 90/270/CEE del Consejo, de 29 de mayo de 1990, referente a las disposiciones mínimas de seguridad y de salud relativas al trabajo con equipos que incluyen pantallas de visualización (Quinta Directiva específica con arreglo al apartado 1 del artículo 16 de la Directiva 89/391/CEE), al no haber adoptado las disposiciones legales, reglamentarias y administrativas necesarias para dar pleno cumplimiento a lo dispuesto en la citada Directiva.
2) Condenar en costas a la República de Austria.
