Abstract

With the end of the Cold War and with the collapse of the bipolar system; USA was

transformed into the only superpower without considerable rival in the international

area. Being in this unfavourable position for the American policy, USA was confronted

with the necessity of “creating a new opponent” that would fill the role of reinforcement

of its position and hegemony in the international board. During this period of time

began the academic activities of the American intellectuals aiming preparation of the

ground in the international board for deliberation of new politics and strategies knitted

by the foreign American policy.

Based on American policymakers and strategists the new opponent has to differ in the

cultural and ideological aspect and it should have the ability to challenge American

security.

The new opponent created by the elite of American policymakers was appointed as

“terrorism” or “radical Islam”. As a result of September the 11th attacks “Islamic

terrorism” or “Islamic radicalism” reinforced its position in the list of the most dangerous

opponents of the strategic interests of the American country.

Even though, Islamic system strictly condemns terrorism, however terrorist attacks,

especially those of September and afterwards are still having negative reflections upon

the image of the members of this religion.

Introduction

Terrorism as one of the most controversial issues of the last period has reflections

and significant impact in the international arena. With the end of the Cold War and

the transformation of the US position - as undisputed leader in the international

scene, for strategic and political reasons, a campaign began labeling Islam with

terror and terrorism. In this paperwork we will try to give a brief retrospective of

the definitions made about terrorism. Then we will examine strategic and political

background of the identification of Islam with terrorism ending with the analysis

of the debate among researchers about how Islamic fiqh concepts the terrorism

from the perspective of Islamic criminal law.

Terrorism: Definition and goals

Before we expound political background of identification and labeling of Islam with

terrorism and Islamic position against terrorism and terrorist acts it would be

appropriate to define the concept and definition of terrorism and terrorist acts, both
