1) ¿Debe interpretarse el artículo 13 de la Directiva 2008/115/CE del Parlamento Europeo y del Consejo, de 16 de diciembre de 2008, relativa a normas y procedimientos comunes en los Estados miembros para el retorno de los nacionales de terceros países en situación irregular (DO 2008, L 348, p. 98; en lo sucesivo, «Directiva retorno»), en relación con los artículos 4, 18, 19, apartado 2, y 47 de la Carta de los Derechos Fundamentales de la Unión Europea, en el sentido de que, si el Derecho nacional prevé un recurso de apelación en procedimientos incoados contra una decisión que contiene una decisión de retorno en el sentido del artículo 3, punto 4, de la Directiva 2008/115/CE, el Derecho de la Unión obliga a que dicho recurso de apelación tenga automáticamente efecto suspensivo cuando el nacional de un tercer país alega que la ejecución de la decisión de retorno entraña un grave riesgo de que se vulnere el principio de no devolución Dicho con otras palabras, ¿deberá en tal caso suspenderse la expulsión del nacional del tercer país de que se trate durante el plazo para la interposición de un recurso de apelación o, si ya se ha interpuesto tal recurso, hasta que se haya resuelto el mismo, sin que este nacional del tercer país tenga que presentar a tal fin una solicitud específica
2) ¿Debe interpretarse el artículo 46 de la Directiva 2013/32/UE del Parlamento Europeo y del Consejo, de 26 de junio de 2013, sobre procedimientos comunes para la concesión o la retirada de la protección internacional (refundición) (DO 2013, L 180, p. 60), en relación con los artículos 4, 18, 19, apartado 2, y 47 de la Carta de los Derechos Fundamentales de la Unión Europea, en el sentido de que, si el Derecho nacional prevé un recurso de apelación en procedimientos sobre la desestimación de una solicitud de concesión de protección internacional, el Derecho de la Unión obliga a que dicho recurso de apelación tenga automáticamente efecto suspensivo Dicho con otras palabras, ¿deberá en tal caso suspenderse la expulsión del solicitante durante el...
