DIRETTIVA 2005/49/CE DELLA COMMISSIONE
del 25 luglio 2005
che modifica, per adeguarle al progresso tecnico, la direttiva 72/245/CEE del Consiglio relativa alla soppressione delle perturbazioni radioelettriche (compatibilità elettromagnetica) dei veicoli e la direttiva 70/156/CEE del Consiglio concernente il ravvicinamento delle legislazioni degli Stati Membri relative all’omologazione dei veicoli a motore e dei loro rimorchi

LA COMMISSIONE DELLE COMUNITÀ EUROPEE,
Visto il trattato che istituisce la Comunità europea,
Vista la direttiva del Consiglio 70/156/CEE del 6 febbraio 1970 concernente il ravvicinamento delle legislazioni degli Stati Membri relative all’omologazione dei veicoli a motore e dei loro rimorchi (1), in particolare l’articolo 13, paragrafo 2 della medesima
Vista la direttiva del Consiglio 72/245/CEE relativa alla soppressione delle perturbazioni radioelettriche (compatibilità elettromagnetica) dei veicoli (2), in particolare l’articolo 4 della medesima,
Considerando quanto segue:
(1) | La direttiva 72/245/CEE è una delle direttive particolari ai sensi della procedura di omologazione fissata dalla direttiva 70/156/CEE. |
(2) | Per migliorare la sicurezza dei veicoli, sviluppando l’uso di tecnologie basate su apparecchiature radar a corto raggio per autoveicoli, la Commissione — ha armonizzato con la decisione 2004/545/CE della Commissione dell’8 luglio 2004 relativa all’armonizzazione dello spettro radio nella banda di frequenze 79 GHz ai fini dell’uso di apparecchiature radar a corto raggio per autoveicoli nella Comunità (3) e con la decisione 2005/50/CE della Commissione del 17 gennaio 2005 relativa all’armonizzazione dello spettro radio nella banda di frequenze 24 GHz ai fini dell’uso limitato nel tempo di apparecchiature radar a corto raggio per autoveicoli nella Comunità (4), l’uso delle due bande di frequenza dello spettro radio. |
(3) | La banda di frequenze 79 GHz dello spettro radio è stata riconosciuta come la più idonea allo sviluppo e all’introduzione a lungo termine e permanente dei sistemi radar a corto raggio per autoveicoli. La decisione 2004/545/CE ha perciò indicato e messo a disposizione di tali apparecchiature, perché funzionino senza interferenza e senza protezione, la banda di frequenze 79 GHz dello spettro radio. La tecnologia nella gamma di frequenze 79 GHz si trova tuttora in fase di sviluppo e non è ancora economicamente vantaggiosa. |
(4) | La decisione 2005/50/CE permette un uso limitato nel tempo della banda di frequenza 24 GHz dello spettro radio alle apparecchiature radar a corto raggio per autoveicoli. La tecnologia che si serve di tale banda di frequenza è disponibile a breve termine a costi ragionevoli, il che renderà possibile valutare rapidamente l’efficacia ai fini della sicurezza stradale delle apparecchiature radar a corto raggio per autoveicoli. L’uso di tale tecnologia radar va tuttavia limitato per evitare interferenze con altre applicazioni che si servono della banda 24 GHz. |
(5) | La decisione 2005/50/CE permette, fino al 30 giugno 2013 e non oltre tale data, l’uso di un’apparecchiatura radar a 24 GHz solo se montata come accessorio originale in veicoli nuovi o ne sostituisce una così montata. Secondo l’articolo 5 della decisione 2005/50/CE, tale data può però essere anticipata. |
(6) | Per ottemperare alla decisione 2005/50/CE, gli Stati membri devono istituire un sistema di controllo che verifichi il numero di veicoli dotati di un radar a corto raggio nella banda 24 GHz immatricolati nel loro territorio. Occorre quindi fornire agli Stati membri mezzi adeguati per effettuare tale verifica. |
(7) | La direttiva 72/245/CEE va dunque modificata di conseguenza. |
(8) | Le modifiche alla direttiva 72/245/CEE si riflettono sulla direttiva 70/156/CEE. Va dunque modificata anche quest’ultima. |
(9) | I provvedimenti messi in atto dalla presente direttiva sono conformi al parere del Comitato per l’adeguamento al progresso tecnico, espresso ex articolo 13 della direttiva 70/156/CEE. |
