RÈGLEMENT (CE) N o 565/2008 DE LA COMMISSION

du 18 juin 2008

modifiant le règlement (CE) no 1881/2006 portant fixation de teneurs maximales pour certains contaminants dans les denrées alimentaires en ce qui concerne l’établissement de la teneur maximale en dioxines et en PCB du foie de poisson

LA COMMISSION DES COMMUNAUTÉS EUROPÉENNES,

vu le traité instituant la Communauté européenne,

vu le règlement (CEE) n° 315/93 du Conseil du 8 février 1993 portant établissement des procédures communautaires relatives aux contaminants dans les denrées alimentaires (1), et notamment son article 2, paragraphe 3,

considérant ce qui suit:

(1) Le règlement (CE) no 1881/2006 de la Commission (2) fixe des teneurs maximales pour certains contaminants dans les denrées alimentaires.
(2) Les teneurs maximales doivent être fixées de façon stricte à un niveau pouvant être atteint grâce au respect des bonnes pratiques, compte tenu du risque lié à la consommation des aliments.
(3) Depuis 2006, des concentrations très élevées de dioxines et de PCB de type dioxine ont été détectées dans des conserves de foie de poisson et notifiées par l’intermédiaire du système d’alerte rapide pour les denrées alimentaires et les aliments pour animaux (RASFF — Rapid Alert System for Feed and Food). Aucune teneur maximale n’a été établie pour le foie de poisson et les produits dérivés de sa transformation. Afin de protéger la santé publique, les autorités compétentes ont interdit la mise sur le marché de ces produits, qu’elles jugeaient dangereux.
