por imperativos de sanción y prevención, habida cuenta de la gravedad de la infracción' y que 'debe tenerse en cuenta la buena fe del infractor a la hora de fijar la sanción que se imponga efectivamente a éste, cuando la determinación del régimen aplicable haya planteado dificultades'. Además, el embargo del vehículo en casos de presunta infracción de la Directiva 83/182/CEE (que puede conducir a una acusación de contrabando, que en Grecia puede, de acuerdo con información de la que dispone la Comisión, llevar a situaciones en que el vehículo es vendido por las autoridades y, por consiguiente, nunca más se devuelve a su propietario inicial, incluso en casos en que el Tribunal competente eventualmente decide que el ciudadano de la Unión es inocente) puede dar lugar a nuevos problemas tras la adopción de la Carta de los Derechos Fundamentales de la Unión Europea (3 ).
Tras haber recibido quejas de ciudadanos griegos, la Comisión abrió un proceso por infracción y decidió iniciar una acción contra Grecia. Asimismo, hay que recordar que la Comisión presentó, en 1998, una propuesta de Directiva del Consejo (4 ), cuyo objetivo general era armonizar el régimen fiscal aplicable a los vehículos automóviles con el concepto y los principios del mercado único.
La Comisión presentó, en septiembre de 2002, una Comunicación sobre la tributación de los vehículos de pasajeros en la Unión Europea (5 ), en la que analiza, entre otras cosas, el modo de eliminar los actuales obstáculos fiscales a la libre circulación de los vehículos de pasajeros en el mercado interior. Sobre la base de los principios enunciados en la Comunicación, la Comisión presentará una nueva propuesta de legislación comunitaria en 2004.
