Decisión de Ejecución (UE) 2020/1745 del Consejo de 18 de noviembre de 2020 sobre la puesta en aplicación de las disposiciones del acervo de Schengen relativas a la protección de datos y sobre la puesta en aplicación provisional de determinadas disposiciones del acervo de Schengen en Irlanda

(1) Mediante la Decisión 2002/192/CE, y de conformidad con el artículo 4 del Protocolo n.o 19 sobre el acervo de Schengen integrado en el marco de la Unión Europea, anejo al Tratado de la Unión Europea y al Tratado de Funcionamiento de la Unión Europea (en lo sucesivo, «Protocolo n.o 19»), el Consejo autorizó a Irlanda a participar en determinadas disposiciones del acervo de Schengen.
(2) De conformidad con el artículo 4, apartados 1 y 3, de la Decisión 2002/192/CE, las disposiciones mencionadas en el artículo 1 de dicha Decisión deben surtir efecto, entre Irlanda y los Estados miembros y otros Estados en los que tales disposiciones ya surtan efecto, cuando en todos esos Estados miembros y otros Estados se hayan cumplido las condiciones previas para la aplicación de dichas disposiciones, en virtud de una decisión de ejecución adoptada por el Consejo, por unanimidad de los miembros a que se refiere el artículo 1 del Protocolo n.o 19 y del representante del Gobierno de Irlanda. El Consejo puede fijar fechas distintas para la puesta en aplicación de las diferentes disposiciones, en función de la materia.
(3) El 8 de enero de 2018, Irlanda expresó su intención de iniciar la aplicación de las siguientes partes del acervo de Schengen: el Sistema de Información de Schengen (SIS) y las normas de protección de datos relacionadas con este.
(4) Mediante carta de 7 de julio de 2020, Irlanda manifestó su intención de iniciar la aplicación de las siguientes partes del acervo de Schengen: cooperación judicial, cooperación en materia de drogas, cooperación policial y el artículo 26 del Convenio de aplicación del Acuerdo de Schengen (2) (en lo sucesivo, «Convenio de Schengen»). En dicha carta, Irlanda también manifestó su intención de aplicar, a partir del 1 de enero de 2022, el artículo 27 del Convenio de Schengen, junto con la Directiva 2002/90/CE del Consejo (3) y la Decisión marco 2002/946/JAI del Consejo (4) , que lo desarrollan, así como las Decisiones 2008/149/JAI (5) y 2011/349/UE (6) del Consejo. Irlanda tiene intención de iniciar a partir del 1 de julio de 2022 la aplicación de la Decisión del Comité Ejecutivo, de 22 de diciembre de 1994 (7).
(5) Irlanda ha indicado pues que está preparada ya para poner en aplicación provisionalmente las disposiciones del acervo de Schengen mencionadas en el artículo 1 de la Decisión 2002/192/CE, en la medida en que estas se refieran al funcionamiento del SIS (en lo sucesivo, «disposiciones relacionadas con el funcionamiento del SIS»), a la cooperación judicial, a la cooperación en materia de drogas, a la cooperación policial y al artículo 26 del Convenio de Schengen, a excepción del artículo 27 del Convenio de Schengen, las Decisiones 2008/149/JAI y 2011/349/UE, y la Decisión del Comité Ejecutivo, de 22 de diciembre de 1994, que deben aplicarse en una fase posterior.
(6) En lo que respecta a la evaluación de Irlanda a efectos de verificar el cumplimiento de las condiciones necesarias para la aplicación de las partes pertinentes del acervo de Schengen en las que Irlanda ha solicitado participar, se aplica el Reglamento (UE) n.o 1053/2013 del Consejo (8). Sin embargo, dado que algunas disposiciones del acervo de Schengen en las que Irlanda participa se deben aplicar con carácter provisional, por lo que las evaluaciones solo se realizarán en una fase posterior, es necesario racionalizar los procedimientos de seguimiento y supervisión establecidos en el Reglamento (UE) n.o 1053/2013 del Consejo, en caso de que dichas evaluaciones demuestren que Irlanda no cumple las condiciones...
