REGOLAMENTO (CE) N. 2842/98 DELLA COMMISSIONE del 22 dicembre 1998 relativo alle audizioni in taluni procedimenti a norma dell'articolo 85 e dell'articolo 86 del trattato CE (Testo rilevante ai fini del SEE)
LA COMMISSIONE DELLE COMUNITÀ EUROPEE,
visto il trattato che istituisce la Comunità europea,
visto l'accordo sullo Spazio economico europeo,
visto il regolamento n. 17 del Consiglio, del 6 febbraio 1962, primo regolamento di applicazione degli articoli 85 e 86 del trattato (1), modificato da ultimo dall'atto di adesione dell'Austria, della Finlandia e della Svezia, in particolare l'articolo 24,
visto il regolamento (CEE) n. 1017/68 del Consiglio, del 19 luglio 1968, relativo all'applicazione di regole di concorrenza ai settori dei trasporti ferroviari, su strada e per vie navigabili (2), modificato da ultimo dall'atto di adesione dell'Austria, della Finlandia e della Svezia, in particolare l'articolo 29,
visto il regolamento (CEE) n. 4056/86 del Consiglio, del 22 dicembre 1986, che determina le modalità di applicazione degli articoli 85 e 86 del trattato ai trasporti marittimi (3), modificato da ultimo dall'atto di adesione dell'Austria, della Finlandia e della Svezia, in particolare l'articolo 26,
visto il regolamento (CEE) n. 3975/87 del Consiglio, del 14 dicembre 1987, relativo alle modalità di applicazione delle regole di concorrenza alle imprese di trasporto aereo (4), modificato da ultimo dal regolamento (CEE) n. 2410/92 (5), in particolare l'articolo 19,
sentiti i pertinenti comitati consultivi in materia di intese e posizioni dominanti,
(1) considerando che è stata acquisita una grande esperienza nell'applicazione del regolamento n. 99/63/CEE della Commissione, del 25 luglio 1963, relativo alle audizioni previste all'articolo 19, paragrafi 1 e 2, del regolamento n. 17 del Consiglio (6), del regolamento (CEE) n. 1630/69 della Commissione, dell'8 agosto 1969, relativo alle audizioni previste all'articolo 26, paragrafi 1 e 2, del regolamento (CEE) n. 1017/68 del Consiglio del 19 luglio 1968 (7), della sezione II del regolamento (CEE) n. 4260/88 della Commissione, del 16 dicembre 1988, relativo alle comunicazioni, denunce, domande e audizioni previste dal regolamento (CEE) n. 4056/86 del Consiglio che determina le modalità di applicazione degli articoli 85 e 86 del trattato ai trasporti marittimi (8), modificato da ultimo dall'atto di adesione dell'Austria, della Finlandia e della Svezia, e della sezione II del regolamento (CEE) n. 4261/88 della Commissione, del 16 dicembre 1988, relativo alle denunce, domande e audizioni previste dal regolamento (CEE) n. 3975/87 del Consiglio, che determina la procedura di applicazione delle regole di concorrenza alle imprese nel settore dei trasporti aerei (9), modificato da ultimo dall'atto di adesione dell'Austria, della Finlandia e della Svezia;
(2) considerando che da tale esperienza è emersa l'esigenza di migliorare alcuni aspetti procedurali dei citati regolamenti; che è quindi opportuno, per ragioni di chiarezza, adottare un unico regolamento sulle procedure di audizione previste dal regolamento n. 17, dal regolamento (CEE) n. 1017/68, dal regolamento (CEE) n. 4056/86 e dal regolamento (CEE) n. 3975/87; che pertanto i regolamenti n. 99/63/CEE e (CEE) n. 1630/69 devono essere abrogati e le sezioni II dei regolamenti (CEE) n. 4260/88 e (CEE) n. 4261/88 devono essere soppresse;
(3) considerando che le disposizioni riguardanti il procedimento dinanzi alla Commissione, secondo la decisione 94/810/CECA, CE della Commissione, del 12 dicembre 1994, relativa al mandato dei consiglieri-auditori per le procedure in materia di concorrenza dinanzi alla Commissione (10), debbono garantire pienamente il diritto degli interessati ad essere sentiti e i diritti della difesa; che a tal fine la Commissione deve distinguere tra il...
