5 POSITIVE ACTION (Article 5 Directive 2000/43, Article 7 Directive 2000/78)
a) Scope for positive action measures
In Estonia, positive action in respect of racial or ethnic origin, religion or belief, disability,
age or sexual orientation is permitted in national law.
The Equal Treatment Act (Article 6) does not prejudice the maintaining or adopting of
specific measures to prevent or compensate for disadvantages linked to ethnic origin, race,
colour, religion or other beliefs, age, disability or sexual orientation. Such action must be
in proportion to the objective being sought. No other clarifications can be found in the text
of the law.
b) Quotas in employment for people with disabilities
In Estonia, national law does not provide for quotas for the employment of people with
disabilities.
