COMMISSION IMPLEMENTING DECISION

of 27 May 2014

concerning the adoption of the work programme and the financing for the year 2014 of activities in the food and feed area to ensure the application of the food and feed legislation

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU, Euratom) No 966/2012 of the European Parliament and of the Council of 25 October 2012 on the financial rules applicable to the general budget of the Union and repealing Council Regulation (EC, Euratom) No 1605/2002 (1), and in particular Article 84 thereof,

Having regard to Council Decision 2009/470/EC of 25 May 2009 on expenditure in the veterinary field (2), and in particular Articles 16, 19, 20, 21, 23 and 27 thereof,

Having regard to Regulation (EC) No 1107/2009 of the European Parliament and of the Council of 21 October 2009 concerning the placing of plant protection products on the market and repealing Council Directives 79/117/EEC and 91/414/EEC (3), and in particular Article 76(1) thereof,

Having regard to Regulation (EC) No 882/2004 of the European Parliament and of the Council of 29 April 2004 on official controls performed to ensure the verification of compliance with feed and food law, animal health and animal welfare rules (4), and in particular Article 66(1)(c) thereof,

Whereas:

(1) In order to ensure implementation of activities in the food and feed area to ensure the application of the food and feed and the plant health legislation, it is necessary to adopt a financing decision and the work programme for 2014. Article 94 of Commission Delegated Regulation (EU) No 1268/2012 (5) on the financial rules applicable to the general budget of the Union establishes detailed rules on financing decisions.
(2) It is appropriate to authorise award of grants without a call for proposals to the bodies identified in the work programme and for the reasons provided therein.
(3) This Decision should allow for the payment of interest due for late payment on the basis of Article 92 of the Financial Regulation and Article 111(4) of Delegated Regulation (EU) No 1268/2012.
(4) For the application of this Decision, it is appropriate to define the term ‘substantial change’ within the meaning of Article 94(4) of Delegated Regulation (EU) No 1268/2012.
(5) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health,

HAS DECIDED AS FOLLOWS:

Article 1

The work programme

The annual work programme for the implementation of Articles 16, 19, 20, 21, 23 and 27 of Council Decision 2009/470/EC, Regulation (EC) No 1107/2009, Article 66(1)(c) of Regulation (EC) No 882/2004, as set out in the Annex, is adopted.

The annual work programme constitutes a financing decision within the meaning of Article 84 of Regulation (EU, Euratom) No 966/2012.

Article 2

Union contribution

The maximum contribution for the implementation of the programme for the year 2014 is set at EUR 5 177 230 and shall be financed from the following lines of the general budget of the European Union for 2014:

(a) budget line 17.04.01 EUR 1 000 000;
(b) budget line 17.04.03 EUR 4 177 230.

The appropriations provided for in the first paragraph may also cover interest due for late payment.

Article 3

Flexibility clause

Cumulated changes to the allocations to specific actions within each work programme not exceeding 20 % of the maximum contribution set in Article 2 of this Decision shall not be considered to be substantial within the meaning of Article 94(4) of Delegated Regulation (EU) No 1268/2012, where those changes do not significantly affect the nature of the actions and objective of the work programme.

The authorising officer responsible may adopt the changes referred to in the first paragraph in accordance with the principles of sound financial management and proportionality.

Article 4

Grants

Grants may be awarded without a call for proposals to the bodies identified in the Annex, in accordance with the conditions specified therein.

This work programme contains implementing measures for the year 2014. On the basis of the objectives given in Council Decision 2009/470/EC, Regulation (EC) No 882/2004, Regulation (EC) No 1107/2009, Regulation (EC) No 1333/2008, Regulation (EU) No 609/2013, Regulation (EU) No 1169/2011, Council Directive 2001/89/EC this work programme contains the actions to be financed and the budget breakdown as follows:
