REGLAMENTO (CEE) No 3497/87 DE LA COMISIÓN
de 20 de noviembre de 1987
relativo a la venta, en el marco del procedimiento definido en el Reglamento (CEE) no 2539/84, de carnes de vacuno en poder de determinados organismos de intervención y destinadas a ser exportadas, por el que se modifica el Reglamento (CEE) no 1687/76 y por el que se deroga el Reglamento (CEE) no 2791/87
LA COMISIÓN DE LAS COMUNIDADES EUROPEAS,
Visto el Tratado constitutivo de la Comunidad Económica Europea,
Visto el Reglamento (CEE) no 805/68 del Consejo, de 27 de junio de 1968, por el que se establece la organización común de mercados en el sector de la carne de bovino (1), cuya última modificación la constituye el Reglamento (CEE) no 467/87 (2), y, en particular, el apartado 3 de su artículo 7,
Considerando que el Reglamento (CEE) no 2539/84 de la Comisión, de 5 de septiembre de 1984, por el que se establecen modalidades especiales de determinadas ventas de carnes de vacuno congeladas en poder de los organismos de intervención (3), modificado por el Reglamento (CEE) no 1809/87 (4), ha previsto la posibilidad de la aplicación de un procedimiento en dos fases para la venta de carnes de vacuno procedentes de existencias de intervención;
Considerando que determinados organismos de intervención disponen de importantes existencias de carnes deshuesadas de intervención; que es conveniente evitar la prolongación del almacenamiento de dichas carnes por razón de los elevados costes que se derivan de ello; que existen mercados, en determinados terceros países para los productos indicados; que es conveniente poner dichas carnes a la venta con arreglo a lo dispuesto en los Reglamentos (CEE) no 2539/84 y no 2824/85 de la Comisión (5);
Considerando que resulta necesario fijar un plazo para la exportación de dichas carnes; que es conveniente fijar dicho plazo teniendo en cuenta la letra b) del artículo 5, del Reglamento (CEE) no 2377/80 de la Comisión, de 4 de septiembre de 1980, por el que se establecen modalidades especiales de aplicación del régimen de certificados de importación y de exportación en el sector de la carne de vacuno (6), cuya última modificación la constituye el Reglamento (CEE) no 3434/87 (7);
Considerando que, con el fin de garantizar la exportación de la carne vendida, procede imponer la obligación de prestar la garantía contemplada en la letra a) del apartado 2 del artículo 5 del Reglamento (CEE) no 2539/84;
Considerando que es conveniente precisar que, habida cuenta de los precios fijados en el marco de la presente venta para permitir la salida de determinados trozos, dichos trozos no podrán beneficiarse, en el momento de su exportación, de las restituciones que se fijan periódicamente en el sector de la carne de vacuno; que, por esta misma razón, conviene también hacer aplicable la nota 7 de la parte 3 del Anexo I del Reglamento (CEE) no 1956/87 de la Comisión, de 3 de julio de 1987, por el que se fijan los montantes compensatorios monetarios aplicables en el sector agrícola así como determinados coeficientes y tipos necesarios para su aplicación (8), modificado por el Reglamento (CEE) no 3495/87 (9);
Considerando que el apartado 1 del artículo 2 del Reglamento (CEE) no 3155/85 de la Comisión, de 11 de noviembre de 1985, por el que se establece la fijación por anticipado de los montantes compensatorios monetarios (10), modificado por el Reglamento (CEE) no 1002/86 (11), establece que el montante compensatorio monetario únicamente podrá fijarse por anticipado cuando la restitución a la exportación se fije por anticipado; que la ausencia de restituciones para los trozos antes mencionados hace imposible que se cumpla dicho requisito; que, no obstante, por razones de equidad, es preciso no aplicar excepcionalmente dicho requisito, a fin de permitir la fijación por anticipado de los montantes...
