REGLAMENTO (CE) No 1847/2003 DE LA COMISIÓN de 20 de octubre de 2003 relativo a la autorización provisional de una nueva utilización de un aditivo y a la autorización permanente de un aditivo ya autorizado en la alimentación animal (Texto pertinente a efectos del EEE) LA COMISIÓN DE LAS COMUNIDADES EUROPEAS,
Visto el Tratado constitutivo de la Comunidad Europea,
Vista la Directiva 70/524/CEE del Consejo, de 23 de noviembre de 1970, sobre los aditivos en la alimentación animal (1), cuya última modificación la constituye la Directiva 2003/7/CE de la Comisión (2), y, en particular, el artículo 3, el apartado 1 del artículo 9 quinquies y el apartado 1 del artículo 9 sexies,
Considerando lo siguiente:
(1) Según la Directiva 70/524/CEE, toda nueva utilización de un aditivo ya autorizado precisa una autorización comunitaria.
(2) En el caso de los aditivos mencionados en la parte II del anexo C de la Directiva 70/524/CEE, que incluye enzimas, puede concederse una autorización provisional para una nueva utilización de un aditivo en la alimentación animal si se cumplen las condiciones establecidas en la mencionada Directiva y si puede suponerse razonablemente, en función de los resultados disponibles, que cuando seutilice para la alimentación animal tendrá uno de los efectos mencionados en la letra a) del artículo 2 de dicha Directiva. Esta autorización provisional puede concederse por un período que no supere los cuatro años.
(3) La enzima que figura en el anexo I del presente Reglamento («la enzima») fue autorizada provisionalmente por primera vez para pollos de engorde mediante el Reglamento (CE) no 1436/98 de la Comisión (3), tras un dictamen favorable del Comité científico de alimentación animal, en particular en lo que se refiere a la seguridad del producto. La autorización provisional de dicho aditivo se prolongó hasta el 30 de junio de 2004 mediante el Reglamento (CE) no 2200/2001 de la Comisión (4).
(4) La empresa productora ha presentado datos nuevos en apoyo de una solicitud para ampliar la autorización de la utilización de la enzima para los pavos de engorde.
