1 Le règlement n_ 1768/92, concernant la création d'un certificat complémentaire de protection pour les médicaments, et notamment son article 3, sous b), doit être interprété en ce sens que, dès lors qu'un produit sous la forme mentionnée dans l'autorisation de mise sur le marché est protégé par un brevet de base en vigueur, le certificat complémentaire de protection est susceptible de couvrir le produit, en tant que médicament, sous toutes les formes relevant de la protection du brevet de base. Une interprétation différente ne permettrait pas d'atteindre l'objectif fondamental du règlement consistant à garantir une protection suffisante pour encourager la recherche dans le domaine pharmaceutique, qui contribue de façon décisive à l'amélioration continue de la santé publique.
2 En l'état actuel du droit communautaire, les dispositions relatives aux brevets n'ont pas encore fait l'objet d'une harmonisation dans le cadre de la Communauté ou d'un rapprochement des législations.
