El texto presentado por la Convención ante la CIG de Roma, abierta el 4 de octubre, adelantaba mucho camino, sobre todo en aquellos aspectos previamente consensuados, para la redacción final del "Tratado Constitucional". Temas de importancia como los valores; los derechos fundamentales, o el espacio de libertad, seguridad y justicia. También se consiguieron avances por parte de la Convención en materia de subsidiariedad y Parlamentos nacionales que tienen como objetivo llevar la decisión política a la instancia más próxima al ciudadano así como reforzar el control político sobre la legislación de la Unión. Obtuvieron acertados resultados el Grupo de Personalidad Jurídica y el de Simplificación que pretendía, como bien dice su nombre, simplificar la organización de la Unión Europea y de sus procedimientos de elaboración de normas e instrumentos jurídicos para hacerlos más comprensibles para los ciudadanos.
La Declaración nº 23 anexa al Tratado de Niza, aludía expresamente a tres cuestiones: la subsidiariedad, el papel de los Parlamentos nacionales y la simplificación de los Tratados. En un principio estos temas fueron sometidos a una lectura intergubernamental por parte de un sector de la doctrina. Con el tiempo y los avances de los trabajos de la Convención se pudo apreciar que se trata de cuestiones que si se ha avanzado en su discusión ha sido gracias a la explicitación del federalismo intergubernamental, reforzando los vínculos entre los Estados y la Unión Europea.
El Grupo de Trabajo I "Subsidiariedad" estaba presidido por el español Iñigo Méndez de Vigo y se encargó de estudiar la importancia del principio de subsidiariedad en la Unión Europea, una de las cuestiones fijada por la Declaración nº 23, anexa al Tratado de Niza. Presentaron suPage 165 informe al Pleno de la Convención en octubre de 2002 concluyendo que es imprescindible mejorar este principio; proponen para ello que la Comisión con cada propuesta legislativa elabore una "ficha de subsidiariedad" para que las dos ramas del legislativo Europeo puedan evaluar mejor su aplicación al caso concreto. Apoyan, también la creación de un mecanismo de alerta precoz, implicando a los Parlamentos nacionales, que podrán al inicio del procedimiento posicionarse sobre el cumplimiento del principio de subsidiariedad y que llegado el caso podrían recurrir al Tribunal de Justicia de las Comunidades Europeas por violación del principio de subsidiariedad.
